In which situation will interest not be added to the retiring partner’s loan account?

Answer and explanation

Correct answer: When the partnership deed or a subsequent agreement expressly provides that no interest is payable

After retirement, the amount due to the partner is generally transferred to the partner’s loan account, on which interest is payable at 6% per annum under Section 37 of the Partnership Act unless there is a contrary agreement. Therefore, interest will not be added when the deed or a valid subsequent agreement expressly provides for zero interest. Lack of cash, a loss, or a credit balance in the capital account does not by itself cancel the interest liability. Exam tip: check the agreement first; in its absence, apply the 6% statutory rule under Section 37.
